1. Scope and provider
These Terms of Service govern the use of the European Journal of Tactical Response & Medicine (EJTRM) subscription portal and all subscription contracts concluded through it. The provider and your contractual partner is:
Stumpf + Kossendey Verlagsgesellschaft mbH
Rathausstraße 1
26188 Edewecht, Germany
Managing director: Christoph Kossendey
Commercial register: AG Oldenburg HRB 120057
VAT ID: DE117828392
Phone: +49 4405 9181-0 · Fax: +49 4405 9181-33
E-mail: service@skverlag.de
These terms apply in the version valid at the time the contract is concluded. Deviating terms of the customer do not apply unless we have expressly agreed to them in writing.
2. Subject matter
We offer paid subscriptions to EJTRM in digital, print, and combined (bundle) formats. The concrete scope, format, term, and price of each plan are shown on the relevant subscription page at the time of ordering. Subscriptions renew unless cancelled (see section 7).
3. Account and registration
Ordering a subscription and submitting manuscripts require a user account. You must provide accurate and complete information and keep your access credentials confidential. You are responsible for activity carried out under your account. You may close your account at any time; this does not affect subscriptions already running until the end of their term.
4. Conclusion of contract
The presentation of plans on the portal is an invitation to order, not a binding offer. By selecting a plan and completing the checkout, you submit a binding offer to conclude a subscription contract. Payment is processed by our payment service provider Stripe Payments Europe, Ltd. The contract comes into effect when we confirm the order or provide access, whichever is earlier. We store the contract text and send an order confirmation by e-mail.
5. Prices and VAT
All prices shown are total prices in euros and include the statutory German value added tax (Preisangabenverordnung). For business customers within the EU who provide a valid VAT identification number, the reverse-charge procedure may apply, in which case tax is calculated accordingly during checkout. Any shipping costs for print subscriptions are shown separately before you complete the order.
6. Payment
Payment is due at the start of each subscription period. Depending on availability, payment methods include credit/debit card, SEPA direct debit, and PayPal, processed securely through Stripe. If a payment fails or is reversed, we may suspend access until the outstanding amount has been settled. Invoices and any credit notes are made available in your account.
7. Term, renewal and cancellation
Unless stated otherwise on the plan, subscriptions run for the term shown at checkout and renew automatically for successive periods of the same length. You can cancel a subscription at any time with effect from the end of the current paid period, either via your account or by notifying us in text form. Already paid periods are not refunded on ordinary cancellation, without prejudice to your statutory rights (see section 8). The right of both parties to extraordinary termination for good cause remains unaffected.
8. Right of withdrawal for consumers
If you are a consumer (a natural person concluding the contract for purposes outside your trade, business, or profession), you have a statutory right of withdrawal:
Withdrawal policy. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day of the conclusion of the contract (for digital access) or, for print copies, from the day on which you or a third party named by you takes possession of the first goods. To exercise your right of withdrawal, you must inform us (Stumpf + Kossendey Verlagsgesellschaft mbH, Rathausstraße 1, 26188 Edewecht, Germany; e-mail: service@skverlag.de; fax: +49 4405 9181-33) by a clear statement (e.g. a letter sent by post, fax, or e-mail) of your decision to withdraw. You may use the model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of withdrawal. If you withdraw, we will reimburse all payments received from you without undue delay and no later than 14 days from the day on which we are informed of your decision, using the same means of payment you used for the original transaction unless expressly agreed otherwise.
Early provision of digital content. Your right of withdrawal expires with regard to digital content not supplied on a tangible medium if you have expressly consented to us beginning performance before the end of the withdrawal period and have acknowledged that you thereby lose your right of withdrawal. Where we begin a paid service at your request during the withdrawal period, you owe a proportionate amount for the service provided up to the point of withdrawal.
9. Provision and availability
Digital access is provided online via your account. Print issues are dispatched to the delivery address you provide according to the publication schedule. We aim for high availability of the digital portal but do not warrant uninterrupted, error-free access; maintenance windows and events outside our control may cause temporary unavailability.
10. Intellectual property
All content published in EJTRM is protected by copyright. A subscription grants you a personal, non-transferable right to access and use the content for your own professional and research purposes. Systematic copying, redistribution, resale, or making content available to third parties is not permitted without our prior written consent. Authors retain their rights as described in the submission and author terms.
11. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body, or health, and under the German Product Liability Act. For slight negligence we are liable only for breach of a material contractual obligation (cardinal obligation), and in that case limited to the foreseeable damage typical for this type of contract. Any further liability is excluded. The content of EJTRM is provided for professional information and does not replace individual medical or legal advice.
12. Data protection
We process personal data in accordance with the GDPR and the German Data Protection Act. Details on what data we collect, why, and your rights are set out in our privacy policy.
13. Online dispute resolution
The European Commission provides a platform for online dispute resolution (ODR) at https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
14. Final provisions
These terms and all contracts concluded under them are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer-protection provisions of your country of residence remain unaffected. If you are a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is our registered office. Should any provision be or become invalid, the validity of the remaining provisions is not affected.
